BUDDY BENEFITS TERMS & CONDITIONS

These Buddy Benefits Terms & Conditions (“Buddy Terms”) govern participation in the Buddy Benefits Programme (“Programme”) offered by Cart Daddy E Hub, a proprietorship concern having its principal place of business at 26, Industrial Colony, Naini, Prayagraj – 211008, Uttar Pradesh, India (hereinafter referred to as “Cart Daddy E Hub”, “we”, “our” or “us”).

By registering as a “Buddy” in the Programme, you (“Buddy”, “you” or “your”) acknowledge and agree to be legally bound by these Buddy Terms, our Terms of Use, Privacy Policy, and other applicable policies displayed on the Platform (together, the “Platform Policies”). If you do not agree, please do not register or participate in the Programme.

1. ELIGIBILITY

1.1. The Programme is open only to natural persons who:
(a) are Indian citizens;
(b) are at least 18 (Eighteen) years of age;
(c) possess a valid PAN and Aadhaar; and
(d) hold a valid Indian bank account in their own name.

1.2. Participation is voluntary. By registering, you confirm that the information you provide is true, accurate and up to date.

2. ENROLMENT & KYC

2.1. To enrol, you must register on the Platform and provide:

• PAN (Permanent Account Number)
• Aadhaar Number (for KYC verification)
• Bank Account Details (for payouts)

2.2. Cart Daddy E Hub will verify these details through authorised third-party service providers and payment gateways.

2.3. You consent to such verification and acknowledge that failure to pass KYC may disqualify you from the Programme.

3. HOW THE PROGRAMME WORKS

3.1. As a Buddy, you may place orders on the Platform from your own account, whether the Products are intended for yourself or for your friends or family members.

3.2. For each successful order you place:
(a) the Product is delivered;
(b) the applicable return/refund window expires; and
(c) no cancellation, return, or refund has been made —

you will earn a monetary benefit (“Buddy Benefit”) credited to your registered bank account.

3.3. Payout Frequency: Buddy Benefits will be disbursed twice a month, specifically on the second and fourth Sunday, for all eligible orders completed in the preceding period.

3.4. The amount or percentage of Buddy Benefit may vary by Product category and will be determined by Cart Daddy E Hub from time to time at its sole discretion.

4. CUSTOMER OF RECORD

4.1. The Buddy placing the order shall be deemed the sole customer of record for all legal, contractual and consumer protection purposes.

4.2. Any warranties, returns, after-sales service, or complaints shall be handled only with the Buddy, regardless of whether the Product is delivered to the Buddy or directly to a friend/family member.

5. TAX DEDUCTION & REPORTING

5.1. Buddy Benefits are treated as commission income under the Income Tax Act, 1961.

5.2. In accordance with Section 194H of the Income Tax Act, 1961, Cart Daddy E Hub is required to deduct Tax Deducted at Source (TDS) at 5% (20% if PAN is not provided) if the total Buddy Benefits payable to a Buddy exceed ₹15,000 in a financial year.

5.3. Grossing Up: Cart Daddy E Hub shall bear the burden of TDS on behalf of the Buddy. This means that the Buddy will always receive the full payout amount as displayed under the Programme, and Cart Daddy E Hub will separately deposit the applicable TDS with the Government of India.

5.4. Cart Daddy E Hub will report such TDS in its quarterly TDS returns and issue Form 16A to Buddies, which can be used to claim TDS credit while filing their Income Tax Return.

5.5. Buddies are solely responsible for declaring Buddy Benefits as part of their taxable income under applicable laws.

6. PROHIBITED ACTIVITIES

You agree not to:
(a) place fake or sham orders solely to earn Buddy Benefits;
(b) cancel/return products after payouts are credited;
(c) misuse multiple accounts to manipulate incentives;
(d) provide false identity, PAN, Aadhaar, or bank details;
(e) act in bad faith or engage in fraudulent transactions.

Cart Daddy E Hub reserves the right to withhold, cancel, or recover Buddy Benefits in case of such activities.

7. DATA PROTECTION

7.1. Cart Daddy E Hub will collect and process your PAN, Aadhaar (masked), and bank details strictly for KYC verification, payout, and compliance purposes.

7.2. All information is handled in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023.

7.3. You may request access, correction, or deletion of your data, but withdrawal of consent may make you ineligible to continue in the Programme.

8. DISCLAIMER & LIMITATION OF LIABILITY

8.1. The Programme is a voluntary benefit scheme and Cart Daddy E Hub does not guarantee any minimum payout or continued availability.

8.2. To the fullest extent permitted by law, Cart Daddy E Hub shall not be liable for any indirect, incidental, or consequential losses arising from your participation.

9. MODIFICATION OR TERMINATION

9.1. Cart Daddy E Hub may, at its sole discretion:
(a) modify or discontinue the Programme;
(b) change payout percentages, timelines, or eligibility criteria; or
(c) suspend or terminate your participation for breach of these Buddy Terms or applicable law.

9.2. Any modification will be notified on the Platform. Continued participation shall constitute acceptance of updated Buddy Terms.

10. GOVERNING LAW & DISPUTE RESOLUTION

10.1. These Buddy Terms shall be governed by the laws of India.

10.2. Any disputes shall be settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended, by a sole arbitrator appointed jointly by both parties.

10.3. The seat and venue of arbitration shall be Prayagraj, Uttar Pradesh, and courts at Prayagraj shall have exclusive jurisdiction.

Complaints will be acknowledged within 48 hours and resolved within 30 days.
